JACKSONVILLE, Fla. -- Police have arrested a man in a home invasion that led to a fatal shooting Friday.

Patrick Lee Smith, 31, is accused in the shooting death during a home invasion of George Maxwell III, 31.

According to the Jacksonville Sheriff's Office, Smith went to a home in the 2100 block of Tilden Street around 1 a.m. with Maxwell for the purpose of a home invasion. The men walked into a back room where they found a resident.

The police report said Maxwell walked in and pointed an assault rifle at the resident, saying, "You know what time it is." The resident said he was afraid so he shot Maxwell, killing him.

Smith was arrested and charged with murder/by other than perpetrator during certain felonies.

Homicide investigators said several people were in the boarding home when police responded to a call about gunfire. The name of the victim has not been released.

Investigators on the scene said the fatal shooting may have resulted from a home invasion robbery.
